Bombay high court allows Bhiwandi civic body to demolish ‘dilapidated building’ – Times of India

MUMBAI: Bombay high court bench of Justices Ujjal Bhuyan and R I Chagla on Tuesday permitted Bhiwandi Nizampur City Municipal Corporation to take steps to demolish a dilapidated ‘C1’ category building in view of the impending monsoon.
The ground plus three storeyed Sayyed building has residential and commercial occupants and J J Xavier counsel for the corporation said the building is “dangerous and dilapidated’’ and needs to be demolished.
The occupants had earlier approached the city civil court, but the HC observed that there was no stay on demolition.
The HC said, “there is no embargo’’ on the civic body to take any action which it considers “fit, proper and necessary …in accordance with law.’’
Earlier in March the HC had stayed demolitions till March 31 due to the Covid pandemic.
